1. Introduction

Welcome to AskAvatar ("we", "us", "our"). By purchasing, downloading, or using the AskAvatar software application, our website (askavatar.web.app), or associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our software or website.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the AskAvatar software for personal and commercial live-streaming purposes on platforms such as Twitch, YouTube, TikTok Live, Kick, and Chaturbate (for AskAvatar Adult), subject to the terms and limitations of this agreement.

3. Restrictions & Prohibited Use

You agree not to:

• Rent, lease, lend, sell, redistribute, sublicense, or commercially re-sell copies of the software application.
• Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of the software or its proprietary integrations.
• Use AskAvatar to broadcast hate speech, harassment, unlawful content, or any material that violates platform terms of service or applicable regional laws.

4. Payments, Licensing & Refunds

AskAvatar licenses are digital products. All payment processing is securely managed by Stripe; we never store or process your credit card or financial credentials on our servers. Due to the immediate digital delivery and nature of downloaded software licenses, all sales are final and non-refundable once software access or download keys have been issued. Please review all features in our public showcase and documentation prior to purchasing.

5. Use of AI & Third-Party Models

AskAvatar incorporates artificial intelligence generation via local models (e.g., Llama 3.2, Piper, Kokoro) and optional third-party APIs (e.g., OpenAI, ElevenLabs, Anthropic, Gemini). AI outputs are inherently probabilistic and generated dynamically. While built-in safeguards and prompt customization are provided, AskAvatar is not liable for unintended, inaccurate, or offensive statements generated by AI models. As the broadcaster, you maintain full operational responsibility for all audio and visual content transmitted on your stream.

6. User Content & Avatar Submissions

By submitting artwork, custom avatar presets, or promotional media to our Avatar Gallery via our contact forms or community channels, you grant AskAvatar a non-exclusive, royalty-free, worldwide license to display and showcase your content in connection with marketing and the community gallery. You confirm that you hold all necessary intellectual property rights to submitted works.

7. Termination

This license is effective until terminated. Your rights under this license terminate immediately without notice if you fail to comply with these Terms of Service. Upon termination, you must cease all use of the software.
